ATEX certificate module B: Why this alone is not enough - avoid liability risks!

In practice, companies often encounter devices that are offered with a so-called EU type examination certificate in accordance with module B of the ATEX Directive (2014/34/EU). But beware: Module B alone does not automatically mean full ATEX conformity and entails enormous liability risks for operators.

What exactly does a Module B certificate mean?

An EU type-examination certificate (Module B) confirms that the tested sample of a product meets the essential health and safety requirements of the ATEX Directive. Important: Only the "type" is tested - not each individual device that is manufactured and supplied.

Why is module B alone not enough?

For full ATEX conformity and legally compliant use in potentially explosive atmospheres, production monitoring (module D, E or F) is also required. This monitoring guarantees that each device corresponds exactly to the tested sample.

Without this additional quality assurance (module D/E/F), the appliance may not be used in potentially explosive atmospheres - operation would simply be illegal.

What are the consequences of non-compliance?

The consequences of using a device without full ATEX certification are serious:

  • Insurance risks: In the event of damage (explosion, fire, personal injury), insurance companies may refuse to pay benefits due to gross negligence.
  • Criminal and civil liability: Operators must expect serious legal consequences such as high claims for damages or criminal prosecution.
  • Official sanctions: Fines, plant closures or even criminal investigations may follow.

What operators should look out for:

  • Always check whether a valid quality assurance module (D/E/F) is available in addition to the Module B certificate.
  • Ask the manufacturer explicitly for the EU Declaration of Conformity (CE marking) and check it.
  • Only buy from reliable, ATEX-experienced suppliers who can provide full proof of certification.
